Terms of Service

These terms govern your use of HyperControl ("the Service"), a product operated by Hyperlink ("we", "us"). By creating an account or using the Service you agree to them. Read them. We try to keep them short and direct.
Who can use HyperControl
You can use HyperControl if you are a person, agency, freelancer, or company who builds, maintains, or resells WordPress sites for clients. You must be the legitimate operator or owner of the WordPress sites you connect to your account, or have explicit authorization from the operator. You are responsible for the contractual relationship between you and your clients.
What HyperControl does
HyperControl lets you remotely toggle the state of WordPress sites you connect to your account: enable a maintenance page, hide the agent plugin, restore the site. The agent plugin you install on a WordPress site reports back to our servers and applies the state you set in the dashboard.
HyperControl is not a debt-collection agency. We do not contact your clients on your behalf. We do not place liens or initiate legal proceedings. The kill-switch is a technical capability you use under your own contractual authority.
Your responsibilities
- Make sure your contracts with end clients clearly establish that the delivered work, license, or hosting is contingent on payment, or otherwise authorise you to suspend access.
- Do not use HyperControl on sites you don't have authorization over.
- Keep your agent secrets confidential. We show each secret to you once; rotate it from the dashboard if you believe it has been compromised.
- Pay your subscription. We restore every site under your account automatically when your subscription ends — but the trade is, no subscription, no service.
Plans, billing, and trials
We offer a 14-day free trial that does not require a payment method. Paid plans are billed monthly via Stripe. Prices are listed on our pricing pageand may change with at least 30 days' notice. Tax (VAT etc.) is applied automatically by Stripe based on your billing details.
You can cancel any time from the Stripe Customer Portal. We do not pro-rate refunds for partial months: you keep service through the end of the period you have paid for, then your domains are restored automatically.
The pay-to-unlock collection feature
If you connect your Stripe account through Stripe Connect to enable pay-to-unlock invoice collection, you authorize us to charge a platform fee equal to 3% of each successful payment that flows through the feature, applied as a Stripe application_fee_amount. The remainder, minus Stripe's own processing fee, is paid to your connected Stripe account.
You can choose to absorb this fee yourself or pass it through to the end client as a late-payment surcharge on the invoice. That choice is yours and is configurable per client.
End-client safeguards
We will never lock an end-client's site for reasons that are not your decision. Specifically: if your subscription with us ends, is cancelled, or fails to renew, every site under your account is automatically restored to its default state (maintenance off, agent plugin visible) within minutes.
We comply with lawful requests for unlocking from the legitimate owner of a site if it is established that you have lost the contractual right to suspend it. In practice this almost never happens because of the previous safeguard.
Acceptable use
You may not use HyperControl to:
- Suspend access to a site you do not have authorization over (including sites of a former employer, sites of clients of an agency you no longer work with, etc.).
- Defraud, mislead, or harass end clients. The maintenance page is deliberately neutral; do not attempt to use it for harassment.
- Interfere with the technical operation of any third party not directly contracted with you.
- Reverse-engineer, redistribute, or resell the Service or the agent plugin source.
Termination
You can delete your account any time. We may suspend or terminate your account if you violate these terms; in that case, every site under your account is restored as described above before access is removed.
Service availability
We work to keep HyperControl available and reliable, but the Service is provided "as is" without warranty of uninterrupted operation. The agent plugin is designed to fail open: if our servers are unreachable, your connected sites stay in their last known state rather than locking unexpectedly.
Limitation of liability
To the maximum extent permitted by law, our liability to you is limited to the amount you have paid us in the twelve months preceding the event giving rise to the claim. We are not liable for indirect or consequential damages.
Changes
We may update these terms. If a change materially reduces your rights we will give you at least 30 days' notice by email and prominent in-product notice before the change takes effect.
Governing law
These terms are governed by the laws of Portugal. Any dispute that cannot be resolved amicably will be brought before the courts of Portugal, unless a non-derogable consumer-protection rule grants you the right to a different forum.
